14. Dispute Resolution

14.1 Informal Resolution

If the parties are unable to resolve the Dispute through informal negotiation, you and Green Lantern Pizza agree that the Dispute shall be finally resolved by binding arbitration administered by a recognized arbitration organization, such as the American Arbitration Association (AAA), in accordance with its Consumer Arbitration Rules then in effect. The arbitration shall be conducted in English and shall take place in our principal place of business or via remote hearing as agreed by the parties. The decision of the arbitrator shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

14.3 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, you and Green Lantern Pizza each waive any right to a jury trial and agree that such claim shall proceed individually on a non-class, non-collective basis.

14.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency equitable relief from a court of competent jurisdiction to prevent irreparable harm pending the conclusion of any arbitration. Claims for intellectual property infringement or misappropriation are also exempt from the arbitration requirement described above.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
